These Terms of service (“Terms”) govern your access to and use of Tonsser. By accessing or using Tonsser, you agree to these Terms. If you don’t agree to these terms, then please don’t use the Service.
When you create a Tonsser profile you must provide your real name and information. When you create a team or accept an invitation to a team on Tonsser you commit to keep information up-to-date ensuring the validity of team members, match schedules and results as best as you can. If you select an identifier for your account or team page we reserve the right to edit, remove or reclaim it, if we believe it is inappropriate (such as a user name or a team name that does not closely relate to a user’s actual name, club or level).
Any use or access by anyone under the age of 13 is prohibited.
You agree that we may automatically upgrade Tonsser, and these Terms will apply to such upgrades.
Tonsser users may post, save, upload and/or contribute (“post”) content to the Service, including pictures, text and results (goals, assists, substitutions, cards etc.). Anything you post or otherwise make available on our service is referred to as “User Content”. You retain all rights in, and are solely responsible for, the User Content you post on Tonsser. However, you grant us a non-excusive, transferable, sub-licensable, royalty-fee, worldwide license to use any User Content that you post on or in connection to Tonsser. This license lasts until you determine your Tonsser account or delete User Content unless your content has been shared with others, and they have not deleted it. Tonsser and its users may retain and continue to use, store, display, reproduce, repost, modify, perform, and distribute any of your User Content that other users have stored or shared through Tonsser. Furthermore, removed content may persist in backup copies for a reasonable period of time (but not available to others).
Tonsser is not responsible for any User Content nor does it endorse any opinion contained in User Content. We reserve the right to remove and modify User Content for any reason including User Content that we believe violates these Terms.
We value feedback from our users, and we are always interested in leaning how to improve and make Tonsser better. If you submit comments, ideas or feedback, you understand that we are free to use them without any restriction or compensation. However, we are not obligated to use comments, ideas or feedback, just as you have no obligation to offer them.
You have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use any and all uploaded data that you submit. Tonsser shall not be responsible or liable for the deletion, correction, destruction, damage, loss or failure to store any uploaded data. Tonsser may try to restore lost data, however we do not make any warrantee to recovering or restoring lost data.
There is no tolerance for objectionable content or abusive users.
We respect the rights of intellectual property owners and expect you to do the same. Accounts with usernames or any other content that misleads others or violates another’s trademark may be updated, transferred or permanently suspended.
We care about the security of our users. We work to protect the security of your content and account, however we cannot guarantee it. Please contact us immediately if any compromise or unauthorized use of your account.
Tonsser may contain links to third-party websites and other events and activities that are not owned or controlled by Tonsser. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service or content from Tonsser, you do so at your own risk and you agree that Tonsser will have no liability arising from your use of or access to any third-party websites, service or content.
These Terms will continue to apply until terminated by either you or Tonsser. Tonsser may terminate or suspend this license at any time with or without cause or notice to you. If you violate these Terms or otherwise create a risk or legal exposure for us, we can stop providing all part of Tonsser to you.
If you use Tonsser for commercial purposes as determined in our sole and absolute discretion, you agree to indemnify and hold harmless Tonsser and its officers, directors, employees and agents, from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs and expenses, including, without limitation, reasonable legal and accounting fees (including costs of defence of claims, suits or proceedings brought by third parties), in any way related to your access to or use of Tonsser, your User Content or your breach of any of these Terms.
We endeavour to provide the best service we can, but you understand and agree that the Tonsser service is provided “AS IS”, without express or implied warranty or condition of any kind. You use the Tonsser service at your own risk. Tonsser disclaims any warranties or conditions of merchantability, fitness for a particular purpose or non-infringement.
Tonsser takes no responsibility and assumes no liability for any User Content that you or any other user or third party posts or transmits using our service. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose. Tonsser does not guarantee, in any way that results, teams, clubs or stats are valid. Use of Tonsser is completely at user’s risk and Tonsser assumes no responsibility. However, we promise to do our best every time.
To the extent permitted by law, Tonsser shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; or (c) unauthorized access, use or alteration of your content.
Notification procedures and changes to these Terms, Tonsser reserves the right to determine the form and means of providing notifications to you, and you agree to receive legal notices electronically if we so choose. We may revise these Terms from time to time and the most current version will always be posted on our website. If a revision, in our sole discretion, is material we will notify you. By continuing to access or use the service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the service.
To provide you with the Tonsser service, Tonsser needs to collect some information about you and this is where we describe the information we collect, what we do with it and how you can manage and control the use of your information. By entering or using the Tonsser service you agree and consenting to the use of your information as explained in the Tonsser Terms of Service. If you don’t agree with these terms, please don’t use the service.
We receive a number of different types of information about you. This is the information we receive:
When you sign up for the Tonsser Service, we may collect information we ask you for, like your username, password, e-mail address, date of birth, gender, postal code and country. If you connect to the Service using your Facebook credentials, you authorise us to collect your authentication information, such as your username, encrypted access credentials, and other information that may be available on or through your Facebook account, including your name, profile picture, country, hometown, e-mail address, date of birth, gender, friends’ names and profile pictures and networks. We may store this information so that it can be used for the purpose explained in section “How we use the information we collect” and may verify your credentials with Facebook.
Your information also includes the information you choose to share on Tonsser, such as a wall post or a comment. We may also collect information you voluntarily add to your profile; such as you’re your height, weight, shirt number primary foot, preferred position or your seasonal statistics to enable you to create your personal football identity.
We may use the information we collect, including your personal information, to: provide, personalise and improve your experience with our Service, ensure technical functioning of the service, develop new features, and analyse your use of the service, including your interaction with the applications and services that are made available, linked to or offered in the service; communicate with you for service related purposes, including promotional e-mails or messages; enable and promote the service, including features and content of the services made available through the service, such as sharing, user interactions, notifications and suggestions, and integrations with third party services.
We may share the information we collect, including your personal information, as follows:
Tonsser is a social service, which offers many ways to find, discover and share content, and we enable and encourage users to explore who else is using the Service and their public profiles. Most of your Tonsser information is or may be publicly available to others by default, such as your name, profile picture and your connection to your team and your seasonal stats, including the personal player information you choose to fill out.
Your information may also be used to notify others, including on the service, via e-mail, and through Facebook and other integrated services, that you have joined Tonsser, and activity related to their Tonsser profiles, content which they follow, or which we think otherwise may be of interest to them.
Information such as player profiles, match facts and squad related information may be used, re-shared or linked to by others on the service or others across the web, so please use Tonsser carefully. Also note that stats and other content added to your player profile may include personal information, such as your name and profile picture, which could enable other persons to find you in the Tonsser Service or other services.
Importantly, to change, or limit access to or sharing of information collected from Facebook or other integrated service, please visit your account settings on that service.
We may display content from third parties, which links to third party websites. We cannot control or be held responsible for third parties privacy practices and content. Please read their privacy policies to find out how they collect and process personal information.
We are very committed to protecting our users’ information. While we take reasonable data protection precautions, no security measures are completely secure, and we do not guarantee the security of user information at any time.
